The website eicon-me.com is owned and managed by Eicon LTD, hereafter referred to as Eicon, a company registered office at: 71, Shelton St., Convent Garden, London, WC2H9JQ, UK. Any access to Eicon website, use of our products and/or services provided by Eicon is subject to the terms and conditions detailed below. By using Eicon products and services, as a paid-user or a user on a trial demo account, or accessing Eicon website, you agree to be legally bound by these terms. Such terms take effect immediately on the first access or use of these services.

Eicon Reports, Articles, and News

Eicon material including reports, articles, and news which are posted online, or distributed via emails, or other media, or social media channels, have been derived from public information, analysis, and research, which Eicon considers reliable. Still, accuracy and completeness of such information cannot be guaranteed. Data provided within such information media is provided on an as-is basis, without any expressed representations of, or any kind of warranty made, including implied warranties of quality, fitness for a particular purpose, non-infringement, security of information, and accuracy of information.

Eicon shall under no circumstances, be liable for any losses or damage to any user, client, or online browsers, resulting in, any loss of data, revenues, expected profits; , business, or any other losses suffered by third parties. Furthermore, Eicon shall not be liable to any indirect, consequential, damages arising from the use of information provided by Eicon regardless of the form of action.

Eicon Software Applications

Software applications marketed by Eicon will operate without defects and will perform substantially in accordance with aby documentation published or provided (subject to any Upgrades). Users acknowledge that:

  1. complex software is never wholly free from defects, errors and bugs, and Eicon gives no warranty or representation that its software applications will be wholly free from such defects, errors and bugs;
  2. Eicon does not warrant or represent that its software applications will be compatible with any application, program, or software other than (i) the interface software provided with such software application; and
  3. Eicon will not and does not purport to provide any legal, taxation, or accountancy advice, under the Agreement or in relation to its software applications, and (except to the extent expressly provided otherwise). Eicon does not warrant or represent that its software applications will not give rise to any civil or criminal legal liability on the part of User or any other person.
USER INDEMNITY

User will indemnify and will keep indemnified Eicon against all liabilities, damages, losses, costs, and expenses (including legal expenses and amounts paid in settlement of any disputes) suffered or incurred by Eicon and arising as a result of any breach by User.

Eicon will indemnify and hold User harmless, from and against any claim against any infringement by its software applications, of a third party's patent, copyright, trademark, or trade secret (an "IP Claim"). Eicon shall, at its expense, defend any alleged IP Claim and pay damages finally awarded against User in connection therewith, providing that User shall:

  1. upon becoming aware of an actual or potential IP Claim, notify Eicon;
  2. provide to Eicon all reasonable assistance in relation to the IP Claim, at Provider's expense;
  3. allow Eicon the exclusive conduct of all disputes, proceedings, negotiations and settlements relating to the IP Claim, provided that: (i) User shall be entitled to participate in same at User's expense, and (ii) Eicon will not compromise or settle any IP Claim unless User obtains a complete release of all liability under such compromise or settlement; and
  4. not admit liability in connection with the IP Claim or settle the IP Claim without the prior written consent of Provider.
LIMITATIONS AND EXCLUSIONS OF LIABILITY

Nothing in the Agreement will limit or exclude the liability of a party for (1) death or personal injury resulting from negligence; (2) fraud or fraudulent misrepresentation by that party; (3) or in any way that is not permitted under applicable law.

Neither party will be liable to the other party in respect of: (1) any loss of profits, income, revenue, use, production or anticipated savings, (2) any loss of business, contracts or commercial opportunities, (3) any loss of or damage to goodwill or reputation, or (4) any loss or corruption of any data, database or software.

Neither party will be liable to the other party in respect of any special, indirect or consequential loss or damage.
